Sub: Railway Servants (Discipline and Appeal) Rules, 1968-Choice of retired Railway servant as Defence Helper - Conditions regarding
In terms of Rule 9(13)(b) of Railway Servants (Discipline and Appeal) Rules, 1968, a Railway servant involved in a disciplinary proceedings may present his case with the assistance of a retired Railway servant subject to such conditions as may be specified by the President from time to time by general or special order in this behalf.
2. Pursuant to the above provisions, such conditions were laid down vide instructions contained in letter No. E(D&A) 92 RG6-148 dated 5.11.1992 read with letter No. E(D&A) 2002 RG6-13 dated 14.5.2003.
3. In supersession of all such instructions, it has now been decided, with the approval of the President, that a Railway Servant may present his case with the assistance of a retired Railway Servant, subject to satisfaction of the following conditions:-
(i) The person whose assistance has been sought by the charged Railway Servant should have retired from a railway service, irrespective of the Railway Administration from which he has retired;
(ii) If the retired Railway servant is also a legal practitioner, the restrictions on engaging a legal practitioner by a delinquent Railway servant to present the case on his behalf, contained in rule 9 (13) of Railway Servants (Discipline and Appeal) Rules, 1968 would apply;

(iii) The retired Railway servant concerned should not have, in any manner, been associated with the case at investigation stage oг otherwise in his official capacity; and
(iv) The retired Railway servant concerned should not act as a defence helper in more than seven cases at a time. Such a retired Railway servant should satisfy the inquiring authority that he does not have more than seven cases at hand including the case in question.

विषयः रेल सेवक (अनुशासन और अपील) नियम, 1968 रक्षा सहायक के रूप में सेवानिवृत्त रेल सेवकों का विकल्प शर्तों संबंधी।
रेल सेवक (अनुशासन और अपील) नियम, 1968 के नियम 9 (13) (ख) के अनुसार, अनुशासनात्मक कार्रवाई में शामिल रेल सेवक, सेवानिवृत्त रेल सेवक की सहायता से अपना मामला उन शर्तों के अध्यधीन प्रस्तुत कर सकता है जो समय-समय पर राष्ट्रपति दवारा इस विषय पर साधारण अथवा विशेष आदेशों दवारा विनिर्दिष्ट की गयी हो।
2. उपरोक्त प्रावधानों के अनुसरण में, ऐसी शर्तें दिनांक 14.5.2003 के पत्र सं. ई (डी एंड ए) 2002 आरजी6-13 के साथ पठित दिनांक 5.11.1992 के पत्र सं. ई (डी एंड ए) 92 आरजी6-148 में समाविष्ट अनुदेशों के तहत निर्धारित की गई थी।
3. उन सभी अनुदेशों का अधिक्रमण करते हुए, राष्ट्रपति के अनुमोदन के साथ, अब यह विनिश्चय किया गया है कि रेल सेवक अपना मामला सेवानिवृत्त रेल सेवक की सहायता से, निम्नलिखित शर्तों को पूरा करने के अध्यधीन, प्रस्तुत कर सकता है :-
(i) आरोपित रेल सेवक दवारा जिस व्यक्ति की सहायता मांगी गई है वह रेल सेवा से सेवानिवृत्त हो चुका हो, चाहे वह किसी भी रेल प्रशासन से सेवानिवृत्त हुआ हो;
(ii) यदि सेवानिवृत्त रेल कर्मचारी एक विधि व्यवसायी भी है, तब आरोपित रेल सेवक दवारा अपनी ओर से मामला प्रस्तुत करने के लिए विधि व्यवसायी

को नियुक्त करने हेतु रेल सेवक (अनुशासन और अपील) नियम, 1968 के नियम 9 (13) में समाविष्ट प्रतिबंध लागू होंगे;
(iii) संबंधित सेवानिवृत्त रेल सेवक मामले में किसी भी प्रकार से, चाहे वह जांच स्तर पर हो या अन्यथा उनकी आधिकारिक क्षमता के अन्तर्गत हो, संबंदध नहीं होना चाहिए; और
(iv) संबंधित सेवानिवृत्त रेल सेवक को एक समय पर 7 (सात) से ज्यादा मामलों में रक्षा सहायक के रूप में कार्य नहीं करना चाहिए। ऐसा सेवानिवृत्त रेल सेवक जांच प्राधिकारी को संतुष्ट करेगा कि उसके पास वर्तमान मामले सहित 7 (सात) से अधिक मामले नहीं है।
