Sub: Disciplinary proceedings under Railway Servants (Discipline and Appeal) Rules, 1968-Observance of procedure reg.

A case has come to the notice of Ministry of Railways where immediately after the closure of the case on behalf of the Disciplinary Authority and submission of statement of defence by the charged official, the Inquiry Officer concluded the inquiry and submitted his report in the case. The Hon'ble Central Administrative Tribunal in the said case have commented adversely on the procedure adopted by the Inquiry Officer observing that the inquiry authority has held the inquiry only on behalf of the prosecution. In an another case, Hon'ble Tribunal has quashed the penalty order on the ground of noncompliance of mandatory requirement of serving a copy of the inquiry report to the charged official by the disciplinary authority before passing final orders in the case in violation of principles of natural justice.

Attention is invited to para 4 of Board's letter No. E(D&A)2014RG6-35 dated 18.02.2015 advising that in cases of deemed suspension under sub rule (2) of rule 5 of Railway Servants (Discipline and Appeal) Rules, 1968, the period of 90 days laid down for reviewing the said suspension will be counted from the date the Railway Servant was released from detention.

NFIR have raised the issue of imposition of penalties of dismissal, removal or compulsory retirement from service on Railway servants by incompetent authorities stating these authorities are relying on the 'Schedule of Powers' (SOPs) prepared with the approval of General Managers for exercising these powers though these SOPs are in violation of Article 311 of the Constitution of India and directives issued by this Ministry on this matter.

In terms of Rule 9(13)(b) of Railway Servants (Discipline and Appeal) Rules, 1968, a Railway servant involved in a disciplinary proceedings may present his case with the assistance of a retired Railway servant subject to such conditions as may be specified by the President from time to time by general or special order in this behalf.

2. Pursuant to the above provisions, such conditions were laid down vide instructions contained in letter No. E(D&A) 92 RG6-148 dated 5.11.1992 read with letter No. E(D&A) 2002 RG6-13 dated 14.5.2003.
