Subject: Filling up Group 'D' vacancies by scrceening and absorption of Casual Labour/Substitutes.

As per the extant instructions, posts in the Group-D categories barring certain exceptions like compassionate appointments, appointments against Sports Quota and posts in Diesel/Loco Sheds and Workshops etc. should be Filled by screening and absorption of Casual Labour and Substitutes.

Instructions have been issued from time to time that prompt action should be taken for screening and absorption of Causal Labour against vacancies wherever existing in accordance with the extant instructions. These instructions were recently reiterated vide Board's letter No. E(NG) II/90/LG-3/31 Pt. dated 23.01.1995 and No. E(NG) II/90/LG-3/31 Pt. dated 31.10.1995 in pursuance of observations/recommendations Committee on petitions (10th Lok Sabha).

Board have been receiving complaints from VIPs Federations etc. that despite the fact that large number of Casual Labour and substitutes with long years of service are waiting for absorption in regular service, the vacancies in Group D are not being filled up by the Railways. This would give an impression that screening and absorption of Casual Labour/ Substitutes is not being processed in the true spirit. This calls for immediate review of the position and necessary action. You are, therefore, requested to take immediate action for filling up the vacancies available in Group-D by screening and absorption of Casual Labour and substitutes as per the extant instructions.

It is also requested that the progress of filling up of Group -D vacancies by screening and absorption of Casual Labour and Substitutes may be included in the PCDO from CPO in the proforma attached. The first such progress report should be sent alongwith monthly PCDO for the month of Dec. '95 to be received by 05.01.1996 endorsing a copy thereof to the undersigned.

Please refer to instructions contained in Board's letter of even number dated 23.01.1995 on the above subject, which were issued pursuant to observations/recommendations of Committee on petitions (10th Lok Sabha) contained in their 14th report presented to the Lok Sabha in May 1994.

Instructions issued vide Board's letter dated 23.01.1995 ibid inter alia stipulated that prompt action should be taken for screening and absorption of casual labour against vacancies wherever existing in accordance with the extant instructions.

Committee on petitions (10th Lok Sabha) have stressed in their 20th report presented to the Lok Sabha on 31.05.1995 that Board's Instructions mentioned above may be implemented at the earliest so that justice is done to the genuine casual labour.

In view of the above, it is reiterated that the instructions contained in Board's letter of even number dated 23.01.1995 should be implemented action taken in the matter may please be intimated to this office at the earliest.

Subject : Petition of Shri Shyam Bihari Lal, Convenor, Railway Shramik Sangharsh Samiti, Moradabad Division Northern Railway Presented by Shri Mohan Singh, M.P.

Kindly refer to the correspondence resting with your letter No. 961.E/123/IRLMSA/ EPLLA/Pt-I dated 06.05.1994 on the above subject.

The above petition was examined by the committee on the petitions (10th Lok Sabha) who, in their 14th Report presented to the Lok Sabha in May 1994, have intcr-alia observed that it was lack of proper maintenance and updating of live registers of causal labour which led to the selection Board to depend upon the certificates issued by the supervisors and gave an opportunity to the concerned supervisors to issue take certificates. The Committee have, therefore, inter-alla recommended as under: —

(i) The Ministry must ensure proper maintenance and updating of live registers of casual labour under supervision of senior officers so as to eliminate the scope of ** in future.

(ii) Pending cases of corruption and irregularities against officials may be finalised without any further delay and appropriate action taken against the guilty persons.

(iii) Genuine casual labour who fulfil the eligibility criteria must be absorbed and regularised without any delay.

3. The above recommendations have been considered by the Railway Board, who desire to reiterate the instructions issued by the Board, from time to time for proper maintenance of Casual Labour live registers. The Railways particular attention, in this connection is invited to instructions issued vide Board's letter No. E(NG) II/78/RL/2 dated 22.11.1984, E(NG) II/87/CL/38 dated 12.06.1987, E(NG) II/78/CL/2 dated 03.12.1983 and E(NG)II/89/CL/1 dated 23.02.1990.

4. As already stipulated in Board's letters in para (3) above, the casual labour live registers should be maintained in duplicate. While one copy should be lodged with the Division, the other copy is to be maintained in the respective field formation on the Zonal Railways. These registers should be reviewed every year and updated preferably during first quarter of the year. The registers so maintained should be scrutinised by senior gazetted officers at least once annually and the record kept in the register itself to show by whom and when it was checked.

5. Board desire that above instructions regarding proper maintenance of casual labour live registers should be scrupulously followed. Any lapse on the part of any authority in this regard should be viewed seriously and deterrent action should be taken against the officers/staff concerned.

6. The Board also desire that in future, the entries in the live register/supplementary live register. Service Book and Casual Labour cards should be the one which should be relied upon while considering the eligibility of the casual labour for re-engagement screening etc.

Board also desire that all pending cases of corruption and irregularities against the officials, in respect of the empanelment of casual labour for absorption as loco cleaner and Fitter Khalasis in the Moradabad Division in 1987-88 examined by the Committee on petitions (Lok Sabha) should be finalised without any further delay and appropriate action taken against the guilty officials under advice to Board.

3. As regards absorption of the Casual Labour, attention is invited to the extant instructions which provide that all posts in the Group D categories barring certain exceptions like compassionate appointments, appointments against sports quota and posts in Diesel/Loco Sheds and workshops etc. should be filled by screening and absorption of casual labour. Board desire that prompt action should be taken for screening and absorption of casual labour. Subject: Recruitment in Group 'D' category on the Railways ofthe staff working in quasi-administrative offices/organizations connected with Railways.

Attention is invited to Board's letter No. E(NG)II/95/RR-1/40 dated 11.06.1997 wherein it was laid down that the staff working in the quasi-administrative offices or organizations connected with the Railways, will henceforth have to compete along with other eligible candidates for recruitment to the Railway service, as and when notifications for recruitment to Group 'D' posts etc. are issued by the Railways/RRBs.

02.  A demand had been raised by both the recognized Staff Federations that those staff of quasi-administrative offices/organizations who were working in these offices as on 10.06.97 should be considered for absorption in Railway service, as was being done earlier in terms of Board's letter No. E(NG)III/77/RR-1/5 dated 26.08.1977

03.  The matter has been considered by the Board. It has now been decided that, as a one time relaxation, the Railways may consider absorption of only those staff of quasi-administrative offices/organizations who were on roll continuously for a period of at least three years as on 10.06.1997, and are still on roll, subject to fulfilment of prescribed educational qualification required for recruitment to Group 'D' posts. Such staff should have been engaged within the prescribed age limit. Such absorption should be resorted to only after  exhausting the list of ex-Casual labour borne on the Live Casual Labour Registers/    Supplementary Live Casual Labour Registers. The Units/Bodies whose staff are proposed to be absorbed in this manner and their total number should however be first intimated to the Board and the process should be undertaken only after Board's clearance. Proposals sent to the Board for such clearance should have the personal approval of the General Manager.

Further to Railway Ministry's letter of even number dated 20.11.1991  it has been decided that instructions contained in the Ministry of Railway's letter of even number dated 31.07.1985, as amended on 13.09.1985 read with their letter No. E(NG)II/84/RR-I/26 dated 04.09.1986  and 15.12.1988  regarding filling up of Group 'D' vacancies subject to certain exceptions by the screening and empanelment of casual labour and substitutes will continue to be in force for vacancies arising upto 30.06.1993 or till further instructions in the matter are issued, whichever is earlier. Attention in this connection is also invited to orders contained in Board's letter No. E(NG)II/88/CL/18 dated 01.11.1988 .

Subject: Recruitment of Gr. D staff in Administrative/Associate offices etc.

In terms of extant instructions all Gr. D vacancies of Zonal Railways (excluding workshops) are to be filled from existing casual labour after due screening wherever such casual labour are available. In the administrative and other associate offices casual labour may not be available for such screening to fill in Gr. D vacancies. Board, therefore, desire that in such cases, the requirement should be met from the screened Gr. D Panels, locally available.

Subject: Engagement of substitutes on the Railways in Gr. 'D' categories.

Railway Board have issued detailed instructions on the subject of engagement of substitutes from time to time and the same have recently been consolidated and reiterated to the Railways vide Board's letter of even number dated 29.01.1991 as Master Circular No. 20 of 1991. Among other things the instructions clearly stipulated that the occasion to engage substitutes should be few and far between. 

2. From the figures furnished by the Railway Administrations at the recent Chief Personnel Officer's conference held in July 92 it is noticed that there are over 15,000 substitutes engaged on the railways in Mechanical, Traffic, Commercial and Medical departments.

2.1 Board, after reviewing the matter have observed that there is need to have stricter control on engagement of substitutes and accordingly desire that from now onwards;

(i)                 any new face substitute should be appointed only with the prior personal approval of the General Manager, even where such practice is not already vogue.

(ii)              Strict control should be exercised on the number of substitutes engaged and serious attempts should be made to bring down their number drastically.


(iii)            Strict control on maintenance of leave records and absenteeism should be enforced.

3.   It is requested that compliance with the above may please be ensured.




Subject:  Regularisation of service of six candidates engaged on casual basis in Grade 'C'/Grade 'D' categories.

Please refer to correspondence resting with your letter No. E/255/Con Seniority/CL/Pt. II dated : 08.06.1992 on the above subject. This matter also became an Agenda item for discussion at the PNM meeting with AIRF held on 11/12.02.1992.

2. In the circumstance explained. Railway Board, after considering the matter have approved of N.F. Railway considering regularisation of the six candidates engaged on casual basis in Grade 'C'/Grade 'D' category as indicated against each at the initial recruitment grade with age relaxation in respect of the over aged candidates (Items 1,2,3 & 6) at the time of initial engagement, as under:

3. Regularisation of the services as above is subject to the Railway satisfying the following stipulations:

(i)  The candidates should be within age limit (after taking service rendered by them as casual employees) subject to upper age relaxation as herein approved by the Board and should possess the requisite educational qualifications of the posts;

(ii) The should have completed 3 years of service in casual capacity;

(iii) The suitability for absorption in Grade ‘C' will be adjudged by a committee of 3 officers including a member from RRB and screening for this purpose includes written test

Attention is invited to this Ministry's letter of even number dated 24.08.1992 extending the currency of the instructions providing for filling up of Group 'D' vacancies barring certain exceptions, by the screening and empanelment of casual labour and substitutes upto 30.06.1993 or till further orders. Board after carefully considering the matter has decided to extend the currency of the said instructions upto 30.06.1996 or till further instructions in the matter are issued, whichever is earlier.

Subject: Composition of Committee for Interview on Railways and RRBs in connection with recruitment to Group 'C' & 'D' posts.

Pursuant to a detailed review of the functioning of the Railway Recruitment Boards, Board have decided as under: —

(i) The extant practice of associating non-official members belonging to SC/ST, Minority and OBC communities in the Interview Committees constituted by the RRBs for recruitment to Group 'C' posts on the Railways be discontinued forthwith and earlier practice of associating serving Railway Officers of appropriate rank belonging to such communities be restored;

(ii) In case serving Railway Officers of appropriate rank belonging to such communities are not available. Central Government/State Government/PSUs/ Bank Officers belonging to these communities may be co-opted. In case of further difficulty, retired Railway officers of proven integrity belonging to these communities may be co-opted in the interview committees.

2. The Board have also decided that the decision as at 1 (i) and (ii) above will equally apply to recruitments to Group 'C' and 'D' posts to be done by the Zonal Railways/ Production Units.

3. The extant instructions regarding composition of the Interview Committees constituted by the Railways and RRBs for recruitment to Group 'C' and 'D' posts on the Railways will accordingly stand modified to the extent as indicated in the preceding paragraphs.

4. Board have also decided that all the existing panels of non-official members belonging to SC/ST, Minority and OBC communities for nomination on Interview Committees constituted by the Railways and RRBs for recruitment to Group 'C' and 'D' posts on the Railways, sent from the Board from time to time be treated as cancelled with immediate effect.

Further to Railway Ministry's letter of even number dated 13.3.1991 it has been decided that instructions contained in the Ministry of Railway's letter of even number                                            dated 31.07.1985 as amended on 13.09.1985 read with their letter No. E (NG) II/84/RR-V 26 dated 04.09.1986 and 15.12.1988 regarding filling up of Group D vacancies subject to certain exceptions by the screening and empanelment of casual labour and substitutes will continue to be in force for vacancies arising up to 30.06.1992 or till further instructions in the matter are issued, whichever is earlier. Attention in this connection is also invited to orders contained in Board's letter No. E (NG) II/88/CL/18 dated 01.11.1988 (RBE 251/88).

Subject: Regularisation of casual labour working in Group 'C' scales.

As the Railway Administrations are aware, instructions have been issued by the Board from time to time on engagement of casual labour, which clearly envisage such engagement to be only in Group 'D' categories barring occasional engagement of casual skilled artisans in Group 'C' scales in terms of provisions contained in paras 2001 to 2007 of Indian Railway Establishment Manual, (1989 edition). Engagement of casual labour in other Group 'C’ categories is not permissible as per extant orders.

2. Instances have, however, come to the notice of the Board where various Railway Administrations have resorted to engagement of casual labour (in open line and construction) in Group 'C' categories (other than skilled artisans) like Works Mistries, P. Way Mistries, IOWs, Pharmacists, etc. resulting in all sorts of administrative and legal complications.

3. The question of regularisation of the casual labour working in Group ‘C’ scales has been under considerations of the Board. After careful consideration of the matter, Board have decided that the regularisation of casual labour working in Group 'C' scales may be done on the following lines:

(i) All casual labour/substitutes in Group ‘C’ scales whether they are Diploma Holders or have other qualifications, may be given a chance to appear in examinations conducted by RRB or the Railways for posts as per their suitability and qualification without any age bar.

(ii) Notwithstanding (i) above, such of the casual labour in Group ‘C’ scales as are presently entitled for absorption as skilled artisans against 25% of the promotion quota may continue to be considered for absorption as such.

(iii) Notwithstanding (i) and (ii) above, all casual labour may continue to be considered for absorption in Group 'D' on the basis of the number of days put in as casual labour in respective Units.

Attention is invited to the instructions contained in Board's letter No. E (NG) II/98/CL/32 dated 09.10.1998 regarding filling up of Group 'D' vacancies in the different departments by screening the casual labour borne on Live/Supplementary Live Casual Labour Registers.

2.  In accordance with the discussions held on the subject, in Board's Office with the CPO (A)s of all Zonal Railways on 01.04.1999, appropriate action may be taken to verify the authenticity of the existing Live/Supplementary Live Casual Labour Registers and for updating the same as on 01.04.1999, in accordance with the instructions contained in Railway Board's letters No. E (NG) II/78/CL/2 dated 21.02.1984 & 22.11.1984, E (NG) II/78/CL/2 dated 25.04.1986, E (NG) II/87/CL/38 dated 12.06.1987 & E (NG) II/78/CL/2 dated 08.12.1988. The final figures of the number of persons of Live/Supplementary Live Casual Labour Registers respectively, as on 01.04.1999, may be informed to Board by 31.05.1999.

Subject: Screening of casual labour borne on the live/supplementary live casual labour register.
[No. E(NG)II/98/CL/32, dated 09.10.1998]

As the Railways are aware, the extant instructions require that Casual Labour Live Registers should be maintained for Open line casual labour (unit-wise) and for the Project casual labour (Division-wise) for each Department in each Division. The copies of these live registers are to be invariably maintained in the Divisional Office and up-dated every year.

1.1 Ref.: Board's letters No. E (NG) /II/84/CL/41, dated 02.03.1987  and 21.11.1984 : Similarly Supplementary Casual Labour Live Registers are to be maintained Division-wise separately for both Open line and Project casual labour who were discharged prior to 01.01.1981 for want of work or due to completion of work and not reengaged thereafter and who had applied by 31.03.1987 for the purpose and were found eligible for the purpose by a Committee of Officers on each Division.

Board's letters No. E (NG) II/63/CL/13, dated 16.09.1963, E(NG)II/78/CL/2, dated 21.02.1984 & 22..] J.I 984, E(NG)II/78/CL/2, dated 25.04.1986 , E(NG)II/87/CL/38, dated 12.06.1987 : Now that the Casual Labour on roll have been absorbed under the special drive during the period from 01.05.1996 to 31.03.1998, further, vacancies in the different departments of a Division/Unit may be filled up by screening the casual labour borne on the Live register(s) and after exhausting them, by screening those borne on the Supplementary live register of the Division/Unit.

2.1 E(NG)II/78/CL/2, dated 08.12.1988 : In case of the casual labour borne on casual labour live registers, the regularisation will continue to be as per their turn according to seniority based on the number of days put in by them as casual labour.

2.2 Board's letters No. E(NG)1I/78/CL/18, dated 21.02.1984, E(NG)II/79/CL/2, dated 03.03.1982, E(NG)1I/88/CL/18, dated 01.10.1988 : However, in case of the casual labour borne on supplementary live register, the extant instructions which stipulate that the persons borne on Supplementary live register will be considered for regularisation based on the service after re-engagement after 01.01.1981 (it may be noted that after such re-employment they would have in any case appeared in the live register as well) have now lost relevance. The same are, therefore, modified to provide that the regularisation of casual labour borne in casual labour supplementary live register will be considered in accordance with the number of days put in by them prior to 01.01.1981, those falling in this category being placed enbloc below any who may have rendered service after re-engagement after 01.01.1981.


3. Board desire that the Notices of screening alongwith the Lists of persons to be screened out of the persons borne on the Live Register and/or Supplementary Live Register as the case may be (the total no. of persons on the List being equal to the no. of vacancies required to be filled up by the screening), shall be issued under the signature of an officer of the Personnel Branch of the Division concerned. In addition to displaying the Notice alongwith the List, on the Notice Board(s), etc. he will also send a letter under his signature enclosing a copy of the Notice and the List to each of the individuals concerned by Registered Post A/D advising that in case the individual does not turn up, his name will be deleted from the Casual Labour Live Register/Supplementary Casual Labour Registers as the case may be, and that thereafter he would have no further claim for consideration for absorption by screening in Group 'D', so that there is no difficulty in taking action for deletion of the names of those who do not turn up.
