References and queries have been received in Board's Office seeking clarification regarding admissibility of option for coverage under Railway Services (Pension) Rules, 1993 in terms of Board's instruction of even number dated 10.03.2023 of those Railway employees, who were appointed on compassionate ground and in whose cases advertisement/notification for recruitment/appointment is not issued.

2. Earlier a similar clarification was sought by Northeast Frontier Railway(NFR) and Federations on the above subject and after consultation with DoP&PW, NFR and the Federations were advised vide Board's letter of even number dated 06.02.2024 and 07.02.2024 respectively, regarding the course of action to be taken in such cases. A copy of clarification issued to NFR vide letter dated 06.02.2024 is enclosed herewith.

Subject: Coverage under Railway Services (Pension) Rules, 1993 in place of National Pension System, of those Railway employees who were recruited on Compassionate Ground.

Please refer to NF Railway's letter dated 11.07.2023 vide which a clarification has been sought regarding admissibility of option for coverage under Railway Services (Pension) Rules, 1993 to those railway employees who were appointed on compassionate ground and in whose case advertisement/notification for recruitment/appointment is not issued.

2. The matter has been examined in consultation with the Department of Pension & Pensioners' Welfare(DoP&PW), the Nodal Department in pensionary matter. It is clarified that the criterion prescribed in the letter of even number dated 10.03.2023 for inclusion under Railway Services (Pension) Rules, 1993 is that the date for advertisement/notification for recruitment/ appointment should be prior to notification for National Pension System i.e. 22.12.2003. Therefore, these instructions are not applicable in the cases where conditions prescribed in instructions dated 10.03.2023 are not fulfilled. Further, the modes of appointments are not relevant to decide applicability of above instructions.
